Member Principles

You must read and agree to the Member Principles before you can become an active member of myBUFC.

Any person or entity ("user or subscriber") accessing the myBUFC web site (the "site" or "service") or any of the information contained herein agrees to and is bound by the following terms and conditions of this myBUFC web site terms of use ("agreement"):

This Agreement is a legal agreement between the Member and Biggleswade United Football Club (known as 'myBUFC' for the purposes of this agreement) for the Services you subscribe to. These Services include the website infrastructure, data storage mechanisms, databases and related designs, content, printed materials, and online or electronic documentation. By using the Services, you agree to be bound by the terms of this Customer Agreement. If you do not agree to the terms of this Customer Agreement, you are not authorised to use the myBUFC Services.

Membership and Membership Payment

Some or all of the following fees and charges may be incurred by the Member:

a. Membership Fees. The Member is responsible for paying annual subscription fees according to the then-current billing terms. Membership fees are non-refundable; and

b. Full payments for all goods and services ordered at, through and/or from Biggleswade United Football Club and its licensees.

Memberships may not be assigned or transferred to any other person or entity.

Upon request, Members will be given access to billing records that support charges for use of the Service.

Membership of myBUFC is £23.50 every 12 month(s) and you agree to be contacted by email from 90 days before your expiry date to request membership renewal.

You agree to pay all applicable charges under this Agreement, including any applicable taxes or charges imposed by any government entity, and that myBUFC may change its minimum pricing at any time.
If the payment cannot be processed for any reason, myBUFC reserves the right to cancel the Service.

Membership Rights

Membership of myBUFC provides each member a single voting right on all issues presented to Members via the Service in relation to the management and business affairs of Biggleswade United Football Club.

Votes will be proposed throughout the membership period on issues requiring decisions from members. Wherever possible, a full and comprehensive range of viable options will be provided to members to vote on and the majority vote will be accepted by Biggleswade United Football Club and actioned as soon as is practically possible.

All elected outcomes from members will be carried out to the best of the clubs ability at all times in a faithful and diligent manner. However, if alternative actions must be followed for reasons beyond the control of the club, these alternative actions will be followed as closely to the members and reported back to members in a concise and timely manner.

Sale of the Trust (and, therefore, the club) to third parties are possible only with a 90% member vote. In such an event, all received funds from the sale will be dontated to a nominated charity.

myBUFC and your Privacy

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully in accordance with the Data Protection Act 1998.

We collect information about you for 2 reasons: firstly, to process your membership and second, to provide you with the best possible service.

We will give you the chance to refuse any marketing email from us or from another trader in the future.

The type of information we will collect about you includes:

your name
address
phone number
email address

We don't take or see at any time as your credit/debit card details are entered directly on the PayPal website and are completely secure at all times.

We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.

Member Account, Password and Security

Your password and and email address are provided by you so that your screen name can be registered with myBUFC upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify myBUFC of any unauthorised use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. myBUFC cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

Forums and Public Content

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not myBUFC, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service.

myBUFC does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will myBUFC be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

You agree to not use the Service to:

upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
harm minors in any way;
impersonate any person or entity, including, but not limited to, a myBUFC official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
upload, post, email, transmit or otherwise make available any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
intentionally or unintentionally violate any applicable UK or international law.

Violation of any of the items in this Section relieves myBUFC of any of its contractual or other legal obligations to Member, including myBUFC's obligations under its Privacy Policy.

myBUFC reserves the right to refuse any or all service to any Member for any reason, at any time, at myBUFC's sole discretion. Member agrees that myBUFC may block its IP address or addresses at any time, and at myBUFC's sole discretion, thereby disallowing Member's continued use of myBUFC's web site.

myBUFC makes no claims or representations about any Web Site not under myBUFC's control that a Member may access from myBUFC's web site - by link, frame, or any other means ("Linked Site"). Any link, frame, or any other means to access any Linked Site provided by myBUFC or otherwise on myBUFC's web site does not constitute myBUFC's endorsement, recommendation, or acceptance of any responsibility for the content of that Linked Site or the operators of that Linked Site.

Copyright and Trademark

All materials on this site ("Online Materials"), including, without limitation, names, logos, trademarks, service marks, images, articles, columns, graphics, photographs, illustrations, artwork, audio clips, video clips, software, and other elements making up the Service are protected by copyrights and other intellectual property rights owned and controlled by myBUFC or by other parties that have licensed their material to myBUFC.

Except as specifically provided herein, no Online Materials may be copied, reproduced, republished, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, without the prior written permission of their respective owners. You may not add, delete, distort, or otherwise modify the content on this site. Any unauthorised attempt to modify any Online Material, to defeat or circumvent myBUFC's security features, or to utilise this site for other than its intended purposes is prohibited.

Members are given permission to print copies of articles for internal, information dissemination use only providing these are not stored, archived or otherwise kept for reference in either physical or electronic storage systems.

All myBUFC services are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The use of the site Services are licensed, not sold.

All title and copyrights in and to the Software are owned by myBUFC or its suppliers. All title and intellectual property rights in and to the content which may be accessed through use of the site Services is the property of the respective content owner and also may be protected by applicable copyright or other intellectual property laws and treaties.

Members may not detrimentally promote myBUFC or its products, nor use the myBUFC name, logos, or copyrighted material, except in the format provided and/or approved by myBUFC. Authorised advertising may be used and is encouraged.

Cancellations and Changes

myBUFC has a 'no refund policy', but in exceptional circumstances, refunds are given at the discretion of the management.

myBUFC reserves the right to terminate Members at any time when it is determined that the Member has violated the provisions of this agreement, including the provisions of these policies and procedures as they may be amended or the provisions of applicable laws and standards of fair dealing. This is at the discretion of myBUFC. Any Member terminated for breach of this agreement shall forfeit all commissions owed and shall have no right of recourse against myBUFC.

Online Conduct

Members agrees not to attempt to damage, deny service to, hack, crack, reverse-engineer, or otherwise interfere (collectively, "Interfere") with myBUFC's web site in any manner. If Member in any way Interferes with myBUFC's web site, Member agrees to pay all damages incurred by myBUFC, including any consequential damages, and agrees that the measure of hard to determine damages will be the highest estimate of damages as provided by myBUFC. Member's Interference with myBUFC's web site relieves myBUFC of any of its contractual or other legal obligations to Member, including myBUFC's obligations under its Privacy Policy. myBUFC will cooperate with the authorities in prosecuting any Members who Interferes with myBUFC's web site, attempts to defraud myBUFC, or attempts to defraud credit card companies or any other parties through Member's use of myBUFC's web site or services.

Modification in Member Agreement or Service

myBUFC reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that myBUFC shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

You agree that myBUFC has no responsibility or liability for the deletion or failure to store any survey data or other Content maintained or transmitted by the Service. You acknowledge that myBUFC reserves the right to delete accounts that are inactive for an extended period of time. You further acknowledge that myBUFC reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

We will make reasonable efforts to bring any changes to the attention of our users, but you should also check this page regularly to familiarise yourself with any updates. These Member Principles are Version 1.0 and there are no previous versions.

These terms apply to all products purchased by consumers from our website for their personal, non commercial use. These terms do not affect your legal rights.

We may change these terms at any time, provided that any such change will not affect any orders you have placed before the change is implemented. The terms currently in effect are those published on this website.
